1.3 The term Authorised Third Parties describes the contractors, agents and third party suppliers with whom U-Element or other members of the U-Element Group enter into agreements from time to time and persons with whom they may contract in order to provide the U-Element Services.
By submitting your information, you consent to the use of your personal information collected by us, in the manner as set out in this Policy.

3.1 The U-Element Website is not directed at parties under 18 years of age. If you are under 18, please get your parent/guardian’s permission beforehand whenever you provide personal information to the U-Element Website. Users without this consent are not allowed to provide U-Element with personal information.
4. THE TYPE OF INFORMATION WE COLLECT
4.1 Personal Information Collection
4.1.1 U-Element collects and uses your personal information (i.e. personal information which identifies you, e.g., your name and postal address, date of birth, gender, telephone and fax numbers, email address, and credit/debit card information; lifestyle) only with your knowledge and consent when you use the U-Element Website, the U-Element Services, make use of our product and service enquiries, or when you respond to communications from U-Element (such as contests, questionnaires or surveys) and other information collected on registration or through surveys.
4.1.2 When you request pages from the U-Element Website server, it automatically collects some information about your preferences, including your IP address. U-Element uses this for online-billing and to help diagnose problems with the U-Element Website and server, to administer the U-Element Website and for the purposes set out in Section 5 below.
4.2 Non-personally Identifying Information
4.2.1 U-Element automatically collects aggregate and demographic information about the use of the U-Element Website, including which pages are most frequently visited, how many visitors the U-Element Website receives daily, how long visitors stay on each page, your preferences and other similar sites based on your browsing (click-stream) activities. This information may include the pages you browse and products and services viewed or ordered for example. This helps U-Element to better provide you with a more enjoyable, customised service and experience in the future.
4.2.2 U-Element uses the information available to create profiles of the U-Element Website user base. U-Element may provide aggregate profile information of its users to advertisers to help tailor information from the advertisers to your interests. For example, U-Element may inform advertisers that it has a certain number of U-Element Membership users that have an interest in a topic and are interested in receiving information about the topic.
4.3 Third Party Information.
4.3.1 U-Element does not monitor or permanently store third party information save for the purpose of accounting, billing or record keeping, or unless required by law.
5. USE OF YOUR PERSONAL INFORMATION
5.1 Your personal information will be used by U-Element, the U-Element Group or Authorised Third Parties, in support of the purposes stated at the time at which it was given or sought, and/or for the following reasons:
5.1.1 For the purposes of technical administration of the U-Element Website.
5.1.2 For research and development.
5.1.3 Statistical analysis.
5.1.4 Customer administration.
5.1.5 Profiling service preferences.
5.1.6 Finance and marketing operations and activities and/or as required in the provision of our services including but not limited to credit control services.
5.1.7 In compliance with any regulatory, statutory or legal obligation imposed on us by any relevant authority.
5.1.8 To service your U-Element subscription account/s (“U-Element Account”) and otherwise operate and provide the U-Element Service to you including but not limited to creating an U-Element Membership and an optional wallet account;

5.1.9 To provide other goods and services by U-Element or its designated representatives and/or business partners to you or parties designated by you and matters ancillary thereto;

5.1.11 To verify and record your personal particulars including comparing it with information from other sources and using the information to communicate with you;
5.1.12 To conduct market research of the users of the U-Element Website and U-Element Service including the number of users, the frequency of use, profile of users and using such analysis for our business plans, the enhancement of our products and services, targeted advertisements and conveying such information in broad aggregate terms to third parties who have or propose to have business dealings with U-Element;
5.1.13 To send you information, promotions and updates including marketing and advertising materials in relation to our goods and services and those of third party organizations selected by U-Element;
5.2 If U-Element wishes to use your personal information for new purposes, U-Element will offer you the means to consent to those new purposes by sending an email to the Webmaster account.
6. DISCLOSURE OF YOUR PERSONAL INFORMATION
6.1 U-Element will not sell or rent your personal information to third parties. Except as provided for herein, U-Element will not disclose personal information about you to any third party without your consent.
6.2 U-Element may from time to time, contact you on behalf of external business partners about particular goods, offers or services that may be of interest to you. In those cases, personal information that may identify you will not be transferred to the third party. All communication whether from U-Element or our business partners will be sent to you by U-Element.
6.3 U-Element may however, need to work with Authorised Third Parties to provide part or all of the U-Element Website, the U-Element Service and/or other services to you or to perform market research and statistical analysis. In such situations, U-Element will share your personal information as is necessary for the Authorised Third Party to perform these services, on a strictly confidential basis. These parties are not allowed to use your personal information disclosed to them except for the limited purpose of providing the particular service for U-Element. By using and continuing to use the U-Element Website you are deemed to have consented to such disclosure.
6.4 Without limiting the above, U-Element may disclose your personal information about you, your U-Element Account and/or your U-Element Membership to companies within the U-Element Group for accounting or reporting purposes, subject to the terms of this Policy.
6.5 U-Element may disclose your personal information to subsidiaries within the U-Element Group or other organisations for the purpose as outlined in this Section 6. U-Element may also provide your information to carefully selected third parties whose products or services it believes may be of interest to you. If you do not wish for U-Element to disclose your information, please send an e-mail to Webmaster account.
7. LINKS TO OTHER WEB SITES
7.1 The U-Element Website may contain, from time to time, links to other web sites. U-Element is not responsible for the privacy practices or the content of such websites or of any third party. You should review the privacy policies of such websites when you visit them. This Policy applies solely to information collected by the U-Element Website.
What is a Cookie?
8.1 When you enter a website your computer will automatically be issued with a cookie. Cookies are text files that are placed in your computer’s hard drive to identify your computer to our server. Generally, cookies themselves only record those areas of the site that have been visited by the computer in question, and the duration. Many websites do this whenever a user visits their site in order to track traffic flow.
8.2 Depending upon the type of browser you are using, you may set your computers to accept all cookies, to notify you when a cookie is issued, or not to receive cookies at any time. The last of these, of course, means that certain personalised services cannot then be provided to you.
8.3 U-Element uses “cookies” to store and track information about you and your use of the U-Element Website. Unless you have an U-Element Membership, U-Element cookies in themselves do not identify the individual user, just the computer used. You may browse the U-Element Website anonymously until such registration.
8.4 The U-Element cookie and information retrieved from the U-Element cookie is used in line with the uses set out in Section 5 above and more specifically:
8.4.1 To help save and retrieve passwords used on the U-Element Website. This way, you will not have to re-enter information upon every new visit to the U-Element Website.
8.4.2 To track information such as the frequency and duration of your use of the U-Element Website, your click-stream as you go through the U-Element Website, your preferred sites, and help us determine whether you came to the U-Element Website from a particular Internet link or banner advertisement.
8.4.3 To analyse the profile of the U-Element Website visitors and users to helps U-Element provide you with better service and to enhance our service.
8.4.4 To personalize the content, banners and promotions that you will see on the U-Element Website.
8.5 Most cookies are “session cookies,” meaning that they are automatically deleted from your computer’s hard drive at the end of a session. You are always free to decline the U-Element Website cookies if your browser permits, although in that case you may not be able to use certain features on the U-Element Website and you may be required to re-enter your password more frequently during a session.

8.6 U-Element uses other third-party advertising companies to serve ads when you visit the U-Element Website. In the course of serving advertisements to the U-Element Website, our third-party advertisers may place or recognize a unique cookie in your computer. These companies may use information retrieved from their cookies to provide advertisements on the U-Element Website and other websites about goods and services that may be of interest to you.
9.1 If you want to prevent one of these third-party companies from sending and reading cookies on your computer, you will need to visit each of their websites individually to request that you be removed from that system.
10. OPTING-OUT, CHANGE, UPDATE OF AND ACCESS TO YOUR INFORMATION
10.1 You will be given the opportunity to ‘opt-out’ of having your information used for purposes not directly related to the U-Element Service and Website at the point where U-Element asks for information. If you do not wish to receive our promotional updates you may opt-out of receiving these communications by replying to UNSUBSCRIBE in the subject line in the email sent or by emailing us at the Webmaster account.
10.2 If you wish to correct, change or update your particulars in your U-Element Membership, please click on “Epass” to do so. You will need to have your user ID and password.
10.3 You may terminate and close your U-Element Membership by logging in to “Epass” from the e-mail address provided by you the time you opened your U-Element Membership and created your user ID and password. Your e-mail must specify your user ID, and expressly state that you wish to terminate your U-Element Membership.
10.4 You can write to us at any time to obtain details of the personal information U-Element holds about you. Please write to us @ http://www.u-element.com/contact-us/ .
Please quote your name, address, user ID and U-Element Account/U-Element Membership number. It would be helpful if you also provide brief details of what information you want a copy of. U-Element may charge a reasonable sum permitted by Malaysian personal data protection legislation to cover our administration costs.
10.5 U-Element reserves the right to refuse to provide our visitors with a copy of their personal information, but will give reasons for our refusal.
11.2 U-Element has implemented security policies, rules and technical measures to protect your U-Element Membership information from unauthorised access, improper use or disclosure, unauthorised modification, unlawful destruction or accidental loss. All our employees and data processors, who have access to and are associated with the processing of personal information, are obliged to respect the confidentiality of your U-Element Membership information.
11.3 While U-Element cannot guarantee that loss, misuse or alteration of data will not occur; U-Element makes reasonable efforts to prevent such unfortunate occurrences.
11.4 Personal information that U-Element collects from you will be stored and backed up securely in an environmentally-controlled location. Only authorized people with user ID and password from U-Element have access to the information.
11.5 You must remember to log off from your U-Element Membership and close the browser window after use so that no unauthorized party can have access. You must not, at any time, divulge your user ID and password to any third party.
12. TRANSFERRING YOUR INFORMATION OUTSIDE OF MALAYSIA
12.1 It may be necessary to transfer your personal information to other group companies or service providers located in countries outside Malaysia. This may happen where our servers or suppliers and service providers are based outside Malaysia or where you use the U-Element Website and/or U-Element Service from countries outside Malaysia. In these instances U-Element will take steps to ensure that your privacy rights are respected in accordance with this Policy.
